The Prevailing Wages on Public Works Act was enacted in 1945. The Act is triggered when construction projects use public funds to build schools, roads, and other projects. There is no minimum dollar contract amount for public works or prevailing wage. All contracts between a public agency and a private contractor or subcontractor to perform work at the cost of the public agency are public works contracts and require the payment of prevailing wages.

Compliance Tips:

  • A separate law applicable only to State college/university construction provides for a $25,000 threshold.
  • Required prevailing wage documents include: The “Statement of Intent to Pay Prevailing Wages” (Intent) documents basic information about the project – such as the “who, what, where, and when” related to the project; and The “Affidavit of Wages Paid” (Affidavit) states the work done on a project, the total hours worked, and the wage rates paid.
